The New Jersey Election Law Enforcement Commission has opened an investigation into Jersey Freedom, the shadowy independent expenditure committee connected to South Jersey Democrats that backed a phantom conservative candidate for State Senate in last year’s mid-term elections, according to a filing made by the panel’s attorney.
Edwin R. Matthews, the ELEC counsel, said the review includes but is not limited to allegations in a complaint filed against Jersey Freedom by the New Jersey Republican State Committee.
The four ELEC commissioners voted last month to file an Amicus Brief in a lawsuit by the state GOP against Jersey Freedom, alleging the tenebrous group violated state election laws.
The attorney for Jersey Freedom, Wiliam Tambussi, said ELEC, not the court, has primary jurisdiction.
“It is the intention of the commission to only address issues before the court as they relate to any alleged violations of the Act and whether the Commission has primary and/or exclusive jurisdiction with respect to those alleged violations,” said Matthews in court filings.
According to Matthews, ELEC intends to apply the state appellate court’s four-party test to determine if the trial court judge, Michael Blee, or ELEC, “should have primary and/or exclusive jurisdiction over Campaign Reporting Act violations.”
Matthews says neither said objects to ELEC filing an Amicus brief.
